Why Your Early-2026 Tariff Data is Now Dangerous
In 2026, a “Free” duty rate in the HTS schedule no longer means zero duty at the port. The tariff landscape shifted again in spring 2026: the Supreme Court invalidated IEEPA tariff authority in February, Section 122 replaced it within hours, the Court of International Trade then ruled Section 122 unlawful in May, and two presidential proclamations rebuilt Section 232 around full customs value. Then on July 24, 2026, Section 122 closed on schedule and new Section 301 Forced Labor tariffs took effect on 60 economies the same day.

The 10% Section 122 surcharge ran its full 150-day statutory term and closed on schedule July 24, 2026. The same day, new Section 301 Forced Labor tariffs took effect on imports from 60 economies at 10-12.5% — and unlike Section 122, they carry no built-in expiration.
